Terms of Service

1. Acceptance of terms
By creating an account or using Tatuo, you agree to these Terms of Service and our Privacy Policy. If you don't agree, don't use the app. These Terms form a binding agreement between you and Tatuo LLC, the company that operates Tatuo.
2. Eligibility
You must be at least 18 years old to create an account, book a tattoo appointment, or offer tattoo services through Tatuo. The service is intended for users in the United States. We verify your age at signup and may refuse or terminate service to anyone who does not meet this requirement.
3. What Tatuo is (and isn't)
Tatuo is only a venue — an online marketplace that connects clients with independent tattoo artists. The agreement for the tattoo itself is solely between the client and the artist. Tatuo does not perform, supervise, direct, or guarantee tattoo services, and does not guarantee any artist's skill, licensing, availability, or conduct. Tatuo is not a party to the transaction or agreement between a client and an artist, and is not responsible for the acts or omissions of either party.
4. Independent contractors
Artists on Tatuo are independent professionals, not employees, agents, partners, or representatives of Tatuo. Tatuo does not set their prices, hours, techniques, or methods, and does not control how or whether they provide their services. Nothing in these Terms creates an employment, agency, joint-venture, or partnership relationship between Tatuo and any artist.
5. Bookings and deposits
Booking a consultation or appointment may require a deposit, handled through our payment processor. How and when your card is authorized and charged, and how refunds work, are described in full in our Refund & Cancellation Policy. Please read it before you confirm a booking.
6. Artist responsibilities
Artists are solely responsible for holding any licenses, permits, or certifications required in their jurisdiction, for complying with all applicable health, safety, and sanitation codes, and for the safety and quality of the work they perform. Tatuo does not verify professional licensure and does not inspect artists' workspaces or practices.
7. Assumption of risk
Tattooing carries inherent health risks, including but not limited to infection, allergic reaction, scarring, bloodborne illness, and dissatisfaction with the result. By booking or receiving a tattoo through Tatuo, you acknowledge and voluntarily assume these risks. To the fullest extent permitted by law, you release Tatuo from any and all claims, injuries, or damages arising out of any appointment, tattoo, or the conduct of any artist or client you connect with through the platform.
8. User content & license
You retain ownership of the photos, portfolio images, messages, reviews, and other content you upload. By posting content, you grant Tatuo a non-exclusive, worldwide, royalty-free license to host, store, and display that content within the app for the purpose of operating the service. You represent and warrant that you have all rights necessary to upload and share anything you post. If you believe content on Tatuo infringes your copyright, see our DMCA Policy.
9. Prohibited conduct
You may not use Tatuo to harass or threaten another user; post content that is illegal, hateful, or that sexually exploits or endangers a minor in any way; impersonate another person; scrape, crawl, or harvest data from the platform; or circumvent the platform's payment or booking systems (for example, by moving a booking off-platform to avoid fees). We may remove content and suspend or terminate accounts that violate this.
10. Account suspension & termination
You may delete your account at any time from Settings. Tatuo may suspend or terminate an account at its discretion, including for violating these Terms or for conduct that we believe harms other users or the platform. Deleting an account is permanent and removes your data as described in our Privacy Policy.
11. Disclaimer of warranties
Tatuo is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including as to the artists you find, the outcome, safety, or quality of any tattoo, the accuracy of listings, and the availability or uninterrupted operation of the service.
12. Limitation of liability
To the fullest extent permitted by law, Tatuo and Tatuo LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the platform — including disputes with, or the conduct of, any artist or client. To the fullest extent permitted by law, our total aggregate liability for any claim relating to the service is limited to the greater of the total fees Tatuo collected from you in the twelve (12) months before the claim, or US$100.
13. Indemnification
You agree to indemnify, defend, and hold harmless Tatuo, Tatuo LLC, and their officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the platform, your content, your conduct, or your violation of these Terms or of any law or the rights of a third party.
14. Binding arbitration; class-action & jury-trial waiver
Please read this section carefully — it affects your legal rights. Except where prohibited by law, any dispute arising out of or relating to these Terms or your use of Tatuo will be resolved by binding individual arbitration, rather than in court. You and Tatuo each waive the right to a jury trial and the right to participate in a class, collective, or representative action. Arbitration will be conducted on an individual basis only.
You may opt out of this arbitration agreement within [30] days of first accepting these Terms by sending written notice to [OPT-OUT ADDRESS / EMAIL AND INSTRUCTIONS — to be finalized by counsel]. If you opt out, neither you nor Tatuo can require the other to arbitrate.
15. Governing law & venue
These Terms are governed by the laws of [YOUR STATE], without regard to its conflict-of-laws rules. To the extent any dispute is not subject to arbitration, it will be brought exclusively in the courts located in [YOUR CITY, STATE], and you consent to the jurisdiction of those courts.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date above. Continued use of Tatuo after a change means you accept the updated Terms.
